Court of appeals dismisses water rate lawsuit

FLINT -- The Michigan Court of Appeals has dismissed a lawsuit challenging two water rate increases in Flint.

The ase filed by City Council President Scott Kincaid and three other Flint residents sought class action status and an injuntion against the city.

However the court has rejected their claims saying water rate increases by Mayor Dayne Walling and Emergency Manager Mike Brown were valid user fees and not an unlawful tax, as argued by the residents' attorney.
