BAY CITY -- The family of a teen who was tased by police and later died is suing the police officer.

17 year old Brett Elder was allegedly tased by Cpl. James Lyman on March 22, 2009 after police were called to an underage drinking party. Reports say Elder fought off police and onlookers.  The boy was then, reportedly, hand-cuffed. Not long after, the boy was tased as he continued to fight police.  The boy later died. Autopsy results suggest the tase may have had a negative effect with the alcohol which caused the thin, teenager to have a severe reaction leading to death.

According to the court docket, Eugene elder, the teen's father, is filing a lawsuit seeking at least $75,000 dollars in damage, claiming Cpl. Lyman used excessive force.
