Kirkpatrick is currently in federal prison

DETROIT (AP) -- Kwame Kilpatrick is scheduled to be deposed in prison by lawyers representing SkyTel in a lawsuit brought by the former Detroit mayor over the release of sexually explicit text messages.

The Detroit News reports the videotaped deposition of Kilpatrick will be on or before Feb. 16.  Kilpatrick in 2009 sued SkyTel, saying it violated his rights with release of records from his city-issued pager.

Some of the messages contained sexually explicit dialogue between the married Kilpatrick and ex-chief of staff Christine Beatty.  They both served jail sentences for lying in court about their affair.

Kilpatrick is in a federal prison in Milan serving a sentence for violating probation.  He and his father also face a sweeping federal indictment that accuses them of taking kickbacks and bribes.
