(AP) -- MOUNT CLEMENS, Mich. - The Macomb County prosecutor says he will ask the Michigan Supreme Court to consider reinstating the first-degree murder conviction of a man accused in the 1990 shooting death of his wife at their comic book store. Eric Smith says the appeal will be filed this week. Forty-eight-year-old Michael George was sentenced to life in prison in June after a jury convicted him of murdering his wife. But a judge overturned the conviction, citing prosecutorial misconduct and new evidence that could point to someone else as Barbara Marie George's killer.
The state appeals court declined to hear Smith's appeal. Smith says it likely would have gone to the Supreme Court anyway. A message seeking comment was left Wednesday for George's attorney.
