PONTIAC, MI. (AP) -- Oakland County Prosecutor David Gorcyca has been cleared of professional misconduct in the case of a Ferndale man accused of sexually assaulting two boys. A three-member panel of the Michigan Attorney Grievance Commission ruled Wednesday that comments Gorcyca made to the media were unlikely to prejudice James Perry's second trial on sex-assault charges.
Gorcyca called the former kindergarten teacher a pedophile. Perry was convicted in September 2006 but the verdict was tossed out last year. A second trial ended in April with a mistrial. The Detroit Free Press reports the Livingston County prosecutor's office took over the case and in May decided there wasn't enough evidence for a third prosecution. Perry repeatedly has denied any wrongdoing.
