Murder conviction won't be reinstated

BAY COUNTY (AP) -- Michigan's highest court has turned down an appeal from prosecutors in the case of a Bay County woman whose murder conviction was overturned.

Donna Yost was sentenced to life in prison after a jury in 2006 convicted her of killing her 7-year-old daughter, Monique, with an overdose of medication.

The state appeals court ordered a new trial, saying the trial judge excluded too much evidence for the defense. The Michigan Supreme Court let that ruling stand Friday.

Authorities claimed Yost killed her daughter to block an investigation of possible sexual abuse by others.

Yost's lawyer tells The Bay City Times he'll seek to have Yost released from prison. The Bay County prosecutor's office was closed Monday for the King holiday.
