Yost moved from prison to jail

BAY COUNTY -- There were protestors outside the Bay County Courthouse Wednesday, calling for Donna Yost's freedom.

Then as Yost walked into the court room handcuffed, more than 50 supporters began cheering.

Supporters even passed out fliers to get people from the community to demand she be set free, but that isn't what happened.

"At this time I will have an action in court that says she is to remain in Bay County and The Department of Corrections will turn her over to the authority of the Bay County Sheriff's Department," said Judge William J. Caprathe.

"Donna's going to stay in Bay County," said Attorney Ed Czuprynski, Yost attorney.

"The question is will she stay in the Bay County Jail or be able to be free in the Bay County community like she did before on bond?"

In April of 2006, Yost was convicted of murdering her 7-year-old-daughter Monique.

She was then sentenced to life in prison.

In March of 2008 an appeals court reversed her conviction.

Then in January of this year Michigan's Supreme Court upheld that ruling.

Yost is set to get a new trial.

The appeals court ruled Yost's rights were violated and that her mental state was not taken into consideration during her trial.

Yost's attorney says his client wants to be free.

"That's all she's been talking about the last three years when she was in prison," said Attorney Ed Czuprynski, Yost attorney.

"She was sent to prison to die in prison. She couldn't even take GED classes cause she's a lifer. Yes she wants to be free." 

The judge did say he will give an opinion in the coming weeks on when and if Donna Yost will be released from jail.
