Central Michigan gets key ruling in ex-player's suit

MOUNT PLEASANT, Mich. - A judge has dismissed much of a lawsuit against Central Michigan University and its women's basketball coach, who was accused of ending a scholarship partly because a player wasn't a lesbian.

CMU denies the allegations. U.S. District Judge Thomas Ludington did not rule on the merits of Brooke Heike's claims this week. But he says CMU, coach Sue Guevara and other officials have immunity and can't be sued in their official capacity.

Ludington says he'll still allow Heike to further argue that athletic director David Heeke was negligent in his hiring and supervision of Guevara. Heike can also elaborate on a defamation claim.

She lost her scholarship after the 2007-08 season. CMU says it was based on her attitude and an unwillingness to work hard.
