Trial set for Clayton Smart in funeral trust fund case

(AP) -- Memphis, Tenn. -- An April 5 trial date has been set in Memphis for a former Oklahoma oilman charged with helping steal millions of dollars from funeral home trust funds in Michigan and Tennessee.

Clayton Smart of Morris, Okla., is the former co-owner of Forest Hill funeral Home. Prosecutors have said millions of dollars were stolen in several states. More than 13,000 policyholders were affected.

Smart's trial is expected to last more than a month. He remains in the Shelby County Jail, unable to make $250,000 bond since his indictment in April 2007.

The trust funds that prosecutors say were raided were to pay for funerals and cemetery maintenance. Authorities in Michigan and Indiana are also investigating as are federal authorities.
