Homeowner kills 16-year-old intruder. Is this always justified?

We're seeing it more often, private citizens shooting criminals claiming self defense.

Tuesday, a 16-year-old intruder broke into a home, and even though the homeowner warned him, he allegedly kept coming.

Then, she shot him in the head, killing him.

Ten minutes before noon, a woman called police saying someone was trying to break into her home in the 1900 block of Roselawn near Cloverlawn in the north end of Flint.

He got into the front window.

The homeowner says she warned him several times that she had a gun but that the intruder did not stop.

You may remember an incident seven months ago, 38-year-old Derrick Walker climbed through the window of the Quick Stop Party Store on Davison Road in Flint.

The clerk, on her first day of the job, shot and killed the intruder.

Genesee County Prosecutor David Leyton says of the Davison Road robbery, "The video was clear. He was coming through the window, and he was approaching her. He wanted to rob her. She was protecting her store and her person."

Leyton says that shooting was justified. He's yet to rule on the Roselawn case, but he says more people are arming themselves. He says he's seeing cases like these more often with more crime and fewer police officers.

"Every case that's come to me in the last year that the police have said 'This could be a justified homicide,' I have agreed," says Leyton.

Neighbors say they're glad the homeowner was not hurt, but they feel bad she was put in this position and had to make a decision she has to live with the rest of her life.

The prosecutor says he still has a few pending cases in which private citizens have shot would-be criminals.

He says those that pull the trigger must prove they were in imminent danger.
