Murder trial begins for DeVontrae Benton

The jury is set and opening arguments began in the case of a man accused of shooting and killing a six-year-old boy in November of 2010.

DeVontrae Benton is accused of killing then six year old Jonaries Holden.

Prosecutors say Benton was aiming for the little boy's father at the time.

Investigators say the 6 year old, his twin brother, and a two year old were riding in the backseat of a vehicle.

Police say the twin's father was driving with another woman in the front seat.

Officers say around 10:00 p.m. Benton confronted the father about a $60 loan then shot twice in the vehicle.

The defendant's family says he's innocent.

"He's not a bad boy at all. He was going to college for a phlebotomy licence. It was the wrong place, wrong time. They're just trying to catch my son up in this. Stay tuned," says Janice Lewis, Benton's mother.

The little boy's family says it's convinced Benton did it and wants to get closure after more than a year of waiting.

"A long, and tragic 16 months and just really seeking justice and hopeful that he gets life without parole," says Marchand Williams, Holden's mother.

The prosecution says witnesses will testify that Benton is to blame, even though it admits to having no gun, no bullet fragments, no d-n-a, and no finger prints.

The defense says there was no gunshot seen and that the defendant had two bullet holes in his vehicle.

The jury is made up of seven men, five women, all are white except for one African American.

After the opening statements, the judge dismissed for the day. Witness testimony will begin Thursday at 9:00 a.m.
