Flint man's sentencing in double-killing postponed

FLINT (AP) -- A sentencing hearing for a Flint man convicted in a 2010 double-killing has been postponed after his lawyer raised double-jeopardy concerns to the judge.

Stanley Smith Jr. was scheduled for sentencing Tuesday in Genesee County Circuit Court. A jury last month convicted him in the deaths of 15-year-old Porsche Turner and 27-year-old Martarien Wilson.

Jurors found Smith guilty of both first- and second-degree murder in Wilson's death.

Defense attorney Barry Wolf says the two different convictions for the same crime constitute double jeopardy.

Judge Geoffrey Neithercut will hear arguments on the issue Thursday.

Authorities say Smith and another man went to a home to commit an armed robbery and fatally shot the Turner and Wilson in November 2010.
