MOUNT CLEMENS, MI. (AP) -- A hearing has been delayed in the second trial of a man accused of murdering his wife in their Detroit area comic book store while the prosecutor seeks to reinstate his conviction from the first trial. Macomb County Circuit Judge James Biernat on Tuesday delayed a pretrial conference to Jan. 27.

Forty-eight-year-old Michael George is accused of shooting Barbara Marie George in their Macomb County store in 1990. He was sentenced to life in prison in June after a jury convicted him of first-degree murder.  However, Biernat overturned the jury's verdict, citing prosecutorial misconduct and new evidence that could point to another suspect.

County Prosecutor Eric Smith has asked the Michigan Supreme Court to consider reinstating the verdict.
