Man freed from prison will face 2nd murder trial

(AP) -- Prosecutors in Detroit are preparing for a second murder trial against a man who spent nearly a decade behind bars before his conviction was thrown out. Dwayne Provience isn't happy with the decision. But he predicted Tuesday that he'll be cleared.

The 36-year-old Provience was released Nov. 3 after a judge threw out his second-degree murder conviction. Law students from the University of Michigan discovered that a police report suggesting another killer was not shared at his 2001 trial. The Wayne County prosecutor's office agreed the conviction should be set aside. But instead of dropping the case, it is preparing to put Provience on trial again.

Rene Hunter was fatally shot in Detroit in 2000. The next court hearing is Jan. 27.
